Our company trademark on the completely different product?
A Korean medium-sized cosmetics company realizes that they are so famous brand in Vietnam. However, they think it is so strange because they just export small amount of products to foreign markets.
This is the case that a Vietnamese company used similar brand with them in their products that were produced in China.
If you have a similar experience as above, you should suspect the possibility of brand theft, rather than parallel import into Vietnam.
They have their own 'choco pie' in Vietnam ?
A Korean confectionery company, Orion, confirmed that a Vietnamese company is using the 'Choco Pie' brand in 2015, and began taking actions immediately with Intellectual Property Office of Vietnam. As a result, it is officially and finally confirmed that it belongs to Orion.
In the case of 'Choco Pie', it could be successful because this is a long-lived brand in other countries so it is pretty simple to prove their name. However it could lead to completely different results if your product is quite new and relatively not famous for.
The vague expectation that your products also will be protected in Vietnam, based on the reputation you have in Korea, can drive you to great losses in the future.
Same pesticide, different ingredients ... And corporate image?
Trademark protection is not limited to retail products. Syngenta, a world-renowned pesticide company, was famous for its excellent products in Vietnam, where agriculture was developed. One day farmers started to raise questions for its performance.
A lawyer, Mr. Hieu in SLF (Seoul Law Firm) was a trademark protection agent for Syngenta at the time and successfully protected the company's image by uncovering pesticide manufacturers that use the company's brand without permission.
In addition, Mr. Jeong, a Korean attorney is also a patent lawyer at the same time, so we can give you a clear opinion based on the laws of both countries what protection your company needs in Vietnam.
